Please read these Terms of Service carefully before using the Elcheck mobile application.

1. Acceptance of terms

By accessing or using the Elcheck app, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the application.

2. Description of service

Elcheck provides a platform for managing plants and devices, monitoring alarms, and processing work requests between technicians and clients. Our service allows technicians to view assigned company plants and devices and manage work requests, while clients can monitor their generator status and submit service requests.

3. User accounts

You are responsible for safeguarding your account credentials and for any activities or actions performed under your account. You must immediately notify Elcheck of any unauthorised use of your account or any other breach of security.

4. User obligations

As a user, you agree to:

• Provide accurate and complete information.
• Update your information as necessary.
• Use the service only for lawful purposes.
• Not misuse or interfere with the service.
• Not attempt to gain unauthorised access to any part of the service.

5. Intellectual property

The Elcheck application and its original content, features, and functionality are and will remain the exclusive property of Ideascape (Pty) Ltd and its licensors. The service is protected by copyright, trademark, and other laws.

6. User content

You retain any and all rights to any content you submit, post or display on or through the service, including but not limited to work requests, comments, and feedback ("User Content"). By submitting User Content, you grant Elcheck a worldwide, non-exclusive, royalty-free licence to use, copy, reproduce, process, adapt, publish, transmit, and display such content for the purpose of providing and improving the service.

7. Limitation of liability

To the maximum extent permitted by law, Elcheck shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the service.
• Any unauthorised access to or use of our servers and/or any information stored therein.
• Any interruption or cessation of transmission to or from the service.
• Any bugs, viruses, or other harmful code that may be transmitted through the service.

8. Disclaimer of warranties

The service is provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Elcheck does not warrant that the service will be uninterrupted or error-free, that defects will be corrected, or that the service or the servers that make it available are free of viruses or other harmful components.

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the service will immediately cease.

10. Changes to terms

We reserve the right to modify or replace these Terms at any time. It is your responsibility to review these Terms periodically for changes. Your continued use of the service after any changes to the Terms constitutes your acceptance of the new Terms.

11. Governing law

These Terms shall be governed and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions. Any disputes relating to these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
